Health Reform has arrived and as a business, you must keep in compliance or be prepared to pay fines. The Federal Government has just released guidelines for employers to follow regarding the notification to employees. Employers are required to send notification to ALL employees of available coverage options by October 1, 2013 and to all new hires within 14 days. This pertains to all employers regardless of the number employeed.
Further clarification is provided in Technical Release 2013-02 called “Guidance on the Notice to Employees of Coverage Options under Fair Labor Standards Act 18B and Updated Model Election Notice under the Consolidated Omnibus Budget Reconciliation Act of 1985.” Section 18B of the FLSA was added as a result of the ACA. And it is 18B of the FLSA that contains the notice requirement that employers must communicate about the ACA with their employees Additional information can be located at: http://www.dol.gov/ebsa/healthreform/

While the exchanges are not fully developed, we anticipate the release of more information in the next two weeks and will share as it is made available. Additionally, our office has established a private exchange for those employers that may elect to receive coverage through an exchange.
